ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 279 IPC, 6 read with 20(1) of Cigarettes ad Other Tobacco Products Act, 2003, 328 IPC and Section 4(1)(a) of Tamil Nadu Prohibition Act, in Crime No.120 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. This is the fifth anticipatory bail application filed before this Court. The earlier bail petition in Crl.O.P. No.32259 of 2024 was dismissed on 23.01.2025 by Hon'ble Mrs. Justice T.V.Thamilselvi, and this anticipatory bail petition is listed before this Court pursuant to the orders passed by the Hon'ble Division Bench of this Court in Crl.O.P. No.31787/2024 on 04.03.2025.
3. The case of the prosecution is that the petitioner along with other accused persons were found in illegal possession of 671 Kgs of banned tobacco products worth about more than Rs.15 lakhs. Hence, the complaint.
4. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.
5 .The learned Government Advocate (Criminal Side) appearing for the respondent submitted that earlier applications filed for anticipatory bail have been dismissed by this Court and this is the fifth anticipatory application. There is no change of circumstances. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
6. Considering the nature of allegations, the fact that the earlier anticipatory bail petition was dismissed on 23.01.2025, and that there is no change in circumstances, this Court is not inclined to grant anticipatory bail to
the petitioner.
