Respondent Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to direct the Respondent to consider the petitioner Representation dated 20.10.2021 seeking appropriate action under Section 8 of the Thiruvalluvar University Act 2002 and also to refer the matter to the DVAC and dispose of the same in accordance with law within a time frame that may be fixed by this Court.

ORDER

(The Order of the Court was made by The Honourable Chief Justice) The learned counsel for the petitioner submits that, during the pendency of the present writ petition, respondent has ordered holding of enquiry and thus, the main grievance of the petitioner gets satisfied. The learned counsel however wants to produce the documents before the Enquiry Officer to support the allegations and thus, he prayed that the permission aforesaid may be given.

2. We have considered the submissions and perused the materials available on record.

3. So far as the main grievance of the petitioner is concerned, it gets satisfied with the order to hold enquiry and thereby, the Writ Petition is dismissed as rendered infructuous. It is however with liberty to the petitioner to produce relevant documents before the Enquiry Officer through the Government, unless it is so permitted by the Enquiry Officer to allow assistance to the Government through the petitioner for production of documents. In case the relevant documents are supplied by the petitioner to the Government, they would be expected to produce them before the Enquiry Officer to the extent they find them to be relevant. There shall be no order as to costs.
