... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Ms.M.Malar, learned counsel for the appellants and Mr.B.Sivakollapan, learned st respondent/Insurance Company are present.
counsel for 1 After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The appellants have preferred this Civil Miscellaneous Appeal seeking to enhance the Award dated 16.06.2025 in M.C.O.P.No. 1618 of 2022 passed by the learned Motor Accident Claims Tribunal, III Court of Small Causes Court, Chennai
2. The Tribunal has passed an award of Rs.4,92,910/- with interest at the rate of 7.5% per annum from the date of petition till the date of deposit along with cost.
3. The parties are present along with their respective counsels. The appellant has preferred the present Civil Miscellaneous Appeal for enhancement of award amount.
4. After great deliberation and discussion, both the parties have agreed for enhancement of award amount with further additional sum of Rs.3,50,000/- (rupees three lakh fifty thousand only) in full quit (inclusive of interest).
5. In view of the compromise arrived at between the parties, the National Lok Adalat hereby declare and decree that the Insurance Company shall deposit the enhanced award amount of Rs.3,50,000/- (rupees three lakh fifty thousand only) in full quit (inclusive of interest), within a period of four weeks from the date of receipt of a copy of this award. On such deposit, the appellants are permitted to withdraw the enhanced award amount.
6. Asfar as the apportionment is concerned, the claimants 1 and 2 are entitled for a sum of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand only) each; the 3rd claimant is entitled to a sum of Rs.50,000/- (Rupees Fifty Thousand only).
7. The Tribunal is directed to transfer the above said award amount to the Bank accounts of the claimants by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition.
