This instant application has been filed by the defendant/applicant seeking to condone the delay of 30 days in filing the written statement.

2. In the affidavit filed in support of this application, it is asserted by the applicant that the respondent/plaintiff is a Senior Citizen having some health issues and he is adviced bed rest. It is further stated that due to illness he could not meet his counsel and take steps to file written statement within the time stipulated.

3. The learned counsel for the respondent/plaintiff vehemently opposed this application on the ground that the applicant has not explained the delay in filing written statement properly. 1/2

4. Having satisfied with the reasons assigned by the applicant in the affidavit filed in support of this application, the same is allowed.
