Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned proceedings Zone-VII/C.No.1919/2016, dated 6.4.2016 issued by the second respondent herein and quash the same and direct the respondents to consider the petitioner's application dated 29.3.2016 for the renewal of the license for the year 2015-2016 and 2016-2017 to run a hotel at No.4, South Park Street, Venkatapuram, Ambattur, Chennai -53, after inspecting the premises and after fulfilment of required provisions. The petitioner challenges the order of the second respondent dated 6.4.2016, in and by which, his trade licence was rejected.
2. Heard Mr.P.Thiagarajan, learned counsel for the petitioner, Mr.K.Soundararajan, learned Standing Counsel appearing for respondents and perused the materials available on record.
3. It is brought to the knowledge of this Court, that a remedy is available before the Commissioner, Chennai Corporation and now, the power is delegated to the Regional Deputy Commissioner (Central), Greater Chennai Corporation.
4. The learned counsel for the petitioner would submit that the petitioner is ready to approach the appellate authority for redressal of his grievance.
5. In the light of the above submissions, the petitioner is directed to file an appeal before the competent authority, within a period of two weeks, from the date of receipt of a copy of this order. Till the disposal of the appeal, the respondents shall not take any coercive action against the petitioner. If no appeal is filed in time, this order would stand cancelled automatically and the respondent shall take action against the petitioner in accordance with law.
