This petition has been filed to condone the delay of 64 days in filing the above appeal.

Though notice was served to the first respondent, he has not appeared before this Court either in person or through Advocate. 3.

Mr.J.Michael Visuvasam, learned counsel takes notice for the second respondent.

Notice to the third respondent was dispensed with. 5.

The learned counsel appearing for the second respondent fairly submits that he has no serious objection to the delay of 64 days being condoned. 6.

In view of the aforesaid submission and having satisfied with the reasons stated in affidavit filed in support of this petition, the delay of 64 days is condoned.

The Registry is directed to number the appeal, if it is otherwise in order and post the same for admission. The Registry is further directed to print the name of the learned counsel for the second respondent in the cause list at the time of admission.
