Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the respondent police to "conduct enquiry and investigate and file a FIR" based on the CSR No.238 of 2016 on 09.06.2016 against the Accused Mr.Devandra Babu, his father S.Ravichandran and his brother R.Nandagopal, within the stipulated time frame as fixed by this Hon'ble Court.

ORDER

This Criminal Original Petition has been filed to direct the respondent police to register an FIR based on the complaint given by the petitioner dated 09.06.2016.

2. Heard the learned counsel appearing for the petitioner and the learned Additional public Prosecutor (Crl.side) appearing for the respondent.

3. The learned Additional Public Prosecutor (Crl.side) submitted that based on the complaint lodged by the petitioner, the petition enquiry is pending in CSR.No.238 of 2016 before the respondent.

4. Recording the submission of the learned Additional Public Prosecutor (Crl.side), the respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.

With the above directions, this Criminal Original Petition is closed.
