ORDER

The petitioner herein alleges that his former employer has given a false compliant, as if he owes money and on the said pretext, with the help of the police he is pressurised to transfer the property of his father in favour of the employer-complainant.

The learned Government Advocate (Crl.Side) states that the complaint has been received against this petitioner and when the petitioner was called for enquiry, instead of participating in the enquiry he had sent a letter stating that it is purely a civil dispute and the complainant can work out his remedy through the Civil Court. Without furnishing details about the dispute, the petitioner has falsely alleged that the police is harassing him.

In the light of the rival contentions, this Court is of the view that the petitioner cannot stay away from the enquiry, when the police summons him for appearance of the enquiry to furnish information. 2/4

Therefore, the respondent police shall cause summons for appearance of the petitioner and on receipt of the said summons, the petitioner shall participate in the enquiry and place the documents, which are in his possession. If the respondent police is convinced that it is purely a civil dispute, they shall not proceed further on the complaint given by S.P.G.Kannan.

With the above observation, this Criminal Original Petition is disposed of.
