PRAYER: Original Petition filed for issuance of Succession Certificate under Section 372 of the Indian Succession Act, 1925 read with Order XXV Rule 6 of Original Side Rules in respect of certain debts belonging to the deceased Rajkumari Singal under Part X of the Indian Succession Act, prays that a Succession Certificate may be granted to 1st petitioner with power to collect the Debts and to receive the interest and dividends on and negotiate and transfer the securities specified in the Schedule here to. ORDER

The petitioners seek Succession Certificate in respect of the securities held by Late Rajkumari Singal, who died intestate on 21.04.2015. The first and second petitioners are children of the deceased, third, fourth and fifth petitioners are the daughter in law and grandchildren of the deceased through her predeceased son.

2. The first petitioner has been examined as PW1. He has produced the death certificates of his parents including late.Rajkumari Singal along with his predeceased brother as Ex.P1, Ex.P2 and Ex.P4 and the legal heirship certificates of the Late Rajkumari Singal and his predeceased brother as Ex.P3 and Ex.P5. A perusal of Ex.P3 and Ex.P5 shows that the petitioners are the only legal heirs of the Late Rajkumari Singal. A paper publication has been made and no objections have been received.

3. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the petitioners, to collect the debt and receive the interest in respect of the securities mentioned in the schedule to the petition.
