Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 2 and 3 to rectify the mistake in the entry made in Patta NO.353 issued in favour of the petitioner with respect to the extent of land owned by the petitioner as 0.02.83 Ares (7 cents = 3052 Sq.Ft. ) of land instead of 0.02.5 Ares in S.No.166/7A1 Kadamalaiputhur Village.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the respondents 2 and 3 to rectify the mistake in the entry made in Patta No.353 issued in favour of the petitioner with respect to the extent of land owned by the petitioner as 0.02.83 Ares (7 cents = 3052 Sq.Ft. ) of land instead of 0.02.5 Ares in S.No.166/7A1 Kadamalaiputhur Village.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 3 and perused the materials available on record.

4. The case of the petitioner is that the petitioner is the owner of 0.02.83 Ares as per the document. Whereas, the entry in the patta the extent of land is indicated as 0.02.5 Ares. Therefore, the petitioner has given a representation to the second respondent to rectify the mistake in the patta. The second respondent in turn has forwarded the same to the third respondent for enquiry and report. But there is no progress from 21.12.2020. Hence, the present Writ 2/5

Petition.

5. The learned Special Government Pleader appearing for the respondents 1 to 3 submitted that on the representation of the petitioner enquiry has been conducted and the Orders will be passed by the second respondent.

In view of the submissions of the learned Special Government Pleader, the second respondent is directed to pass an Order on the representation of the petitioner dated 26.07.2018 on its own merits and in accordance with law within a period of two months from the date of receipt of a copy of this order.
