2. Heard both sides.

3. The main person is the first petitioner. Petitioners 2 and 3 are her relatives. The first petitioner is a flat promoter in Thiruverkadu. She constructed certain flats. The Defacto Complainant and others purchased flats from her. Both entered into a construction agreement containing terms and conditions. The Defacto complainant was allotted a flat. He took possession of it. He is enjoying it. Now, he complains that there are some defects in getting connection for certain utilities and facilities and it is all because of the flat promoters.

4. It has been submitted by the learned counsel for the petitioners that the defacto complainant took possession of the property after fully satisfied with the terms and conditions. Even though there is dispute between the flat promoter and purchaser, he has to approach a competent civil forum. But, the defacto complainant approached the police station. P. DEVADOSS, J.,

5. Considering all the above aspects and the nature of the allegations made, I am inclined to grant anticipatory bail to the petitioner.

Ordered as under:- (i)Anticipatory bail granted to the petitioners; (ii) Petitioners shall surrender before the learned Judicial Magistrate, Poonamallee, within 15 days of receipt of a copy of the order; (iii) Petitioners shall execute a bond for Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate;

(iv) Petitioners shall appear before the respondent police as and when required for interrogation.
