This Civil Revision Petition is filed seeking for a direction to the First Additional District Munsif - cum - Rent Controller, Coimbatore to dispose of E.P.No.231 of 2008 within a time frame.
2. Mr.N.Anand Venkatesh, learned counsel appearing for the petitioner submitted that the petitioner as a landlord initiated eviction proceedings against the respondent in R.C.O.P.No.124 of 2004. After trial, the Rent Controller ordered eviction on 19.11.2007. The order of eviction was confirmed eventually by the Honourable Supreme Court on 09.09.2013. The petitioner has filed Execution Petition in E.P.No.231 of 2008 and even after dismissal of the Special Leave Petition, the petitioner, who is a senior citizen, aged bout 80 years is not able to take possession of the petition property. Learned counsel further submitted that the respondent without paying rent is enjoying the property and with a mala fide intention dragging on the proceedings.
3. Considering the facts of the case and the submissions of the learned counsel appearing for the petitioner, learned First Additional District Munsif - cum - Rent Controller, Coimbatore is directed to dispose of E.P.No.231 of 2008, as expeditiously as possible, preferably on or before 30.6.2015.
4. This Civil Revision Petition is disposed of accordingly. No costs.
