PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, praying to set aside the fair and decreetal order dated 20.02.2015 passed by the Learned VI Assistant Judge, City Civil Court, Chennai in I.A.No.19726 of 2014 in O.S.No.5965 of 2013. For Petitioner :

O R D E R

The petitioner filed an application in I.A.No.19726 of 2014 before the Trial Court invoking the Order XI Rule 14 CPC r/w Section 151 of CPC to direct the respondent to produce certain documents. Since the details of those documents were not furnished, the Trial Court dismissed the application.

2. The learned counsel for the petitioner submitted that the petitioner is in possession of xerox copy of the documents and as such, liberty should be given to file a comprehensive application under Order XI Rule 14 CPC.

3. The learned counsel made an endorsement indicating that he is withdrawing the application in I.A.No.19726 of 2014.

4. The learned counsel for the respondent submitted that in case a proper application is filed along with reasonable description of documents, the respondent would answer as to whether they are in possession of those documents.

5. In view of the endorsement made by the learned counsel for the petitioner, application in I.A.No.19726 of 2014 is dismissed as withdrawn.

6. The petitioner is given liberty to make a comprehensive application along with a list of documents, so as to enable the respondent to produce it or to express inability.

The Civil Revision Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
