Respondent Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondent to issue running licence to the mill established by the petitioner M/s.Lakshmi Mills in R.S.No.631, Koothampoondi road, Vikravandi, Villupuram District by the petitioner. By consent, the writ petition is taken up for final disposal.

According to the petitioner, he was originally running a bone mill in S.No.631, Koothampoondi road, Vikravandi Taluk, Villupuram District, and since the respondent interfered with the running of the said mill, he filed O.S.No.734 of 2004 on the file of the District Munsif Court, Villupuram, wherein the respondent has also entered appearance as the defendant. Subsequently a compromise came to be entered into between the parties and joint memo of compromise was filed on 09.12.2004, wherein the petitioner has agreed to close the bone mill with liberty to start a new poultry feed mill in the property and the said compromise decree came to be passed on 09.12.2004. It is the specific case of the petitioner that he got clearance from all authorities to start a new poultry feed mill and after getting necessary permission, he has approached the respondent by submitting a representation dated 13.04.2015 and since he has not favoured with any response, he came forward to file this writ petition.

3. Heard the submissions of Mr.N.Suresh, learned counsel appearing for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice for the respondent. https://hcservices.ecourts.gov.in/hcservices/

Though the petitioner prayed for a positive direction, this Court, in the facts and circumstances, is of the view that it would be suffice to direct the respondent to dispose of the representation dated 13.04.2015, in accordance with law, within the stipulated time frame.

This Court, without going into the merits of the representation, directs the respondent to consider and dispose of the representation of the petitioner dated 13.04.2015 in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
