38. R.Radhakrishnan .. Respondents Civil Revision Petition filed under Article 227 of the Constitution of India praying for speedy disposal of the above suit in O.S.No.7 of 2008 pending on the file of the Principal Sub Judge, Chengalpattu. For petitioner ... Mr.Ravichandran Sudaresan
O R D E R
The revision is filed seeking a direction to the Principal Sub Judge, Chengalpattu for speedy disposal of O.S.No.7 of 2008, which is filed for declaration that the cancellation deed dated 06.05.1998 is null and void.
2.
It is seen from the papers that there is no relief sought against the present revision petitioner. However, it is his case that because of the pendency, the petitioner is unable to move the revenue authorities for mutation of his name. The suit is pending from the year 2008 without any progress. It is also not known whether all the defendants have filed their written statement. The revision petitioner claims to be a senior citizen and seeks speedy disposal of the suit. 3.
Whether the revision petitioner is entitled to ask for such relief or not, it is incumbent upon the learned Judge to dispose of the suit, which is of the year 2008 at the earliest. Therefore, this Court is inclined to give a direction to the Principal Sub Judge, Chenglpattu to dispose of the suit in O.S.No.7 of 2008 within a period of six months from the date of receipt of a copy of this order.
4.
With the above direction, the Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
