The petitioner seeks issuance of Succession Certificate in respect of the securities that stood in the name of M.S.Sakunthala who died intestate on 25.02.2009.

2. The petitioner is the only son of the deceased. Her husband had pre-deceased her. The petitioner has examined himself as PW1. He has produced the death certificate of the deceased M.S.Sakunthala as Ex.P1 and the legal heirship certificate as Ex.P2. A perusal of Ex.P2 shows that the petitioner alone is the legal heir of the deceased M.S.Sakunthala. It also discloses that her husband predeceased her.

3. In view of the said evidence, I find that the petitioner is entitled to Succession Certificate in respect of the securities mentioned in the schedule to the petition.

4. Accordingly, this Original Petition is allowed granting Succession Certificate in respect of the securities mentioned in the petition in favour of the petitioner.
