This petition has been filed to modify the condition imposed in para 6(a) of the order dated 02.03.2023 in so far as permitting the defacto complainant to withdraw the amount from the Crime No.568 of 2022 in the above Criminal Original Petition.

2. Today, when the matter taken up for hearing, Mr.R.Prabakar, learned counsel for petitioner would submit that as the defacto complainant is not the owner of the vehicle, he cannot be allowed to withdraw the amount. He would also submit that the defacto complainant has also made wild allegations in respect of some other incidents. Hence, he prayed to modify the condition.

3. Considering the facts and circumstances and also the submissions of learned counsel for petitioner, this Court is not inclined to modify the condition imposed by this court. Accordingly, this Criminal Miscellaneous Petition is dismissed. However, time is extended for further period of two weeks for compliance of the order from the date of receipt of copy of this order.
