Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 2nd respondent herein to consider and pass orders on the petitioner's representation dated 31.10.2013 for issue of patta in respect of lands measuring to an extent of 0.26 cents in Survey No.271/5 situated at Samanapalli village, Hosur Taluk, Krishnagiri District within the time to be stipulated by this Court.

ORDER

Heard Mr.R.Bharathikumar, learned counsel appearing for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader appearing for the respondents 1 to 3 and perused the materials available on record.

2.The petitioner seeks for issuance of a writ of mandamus to direct the 2nd respondent to consider and pass orders on her representation dated 31.10.2013 seeking for issuance of patta in the lands in question.

3.A counter affidavit has been filed by the Tahsildar stating that on verification, he has come to know that Venkataramanaiah, the 4th respondent herein, is not residing in the village and the land in the said survey number is in the possession of the writ petitioner. 4.Learned counsel for the petitioner would submit that the 4th respondent had already expired.

5.Learned Special Government Pleader appearing for the respondents 1 to 3 would submit that after making an enquiry with the petitioner and the legal heirs of the deceased/4th respondent and after perusing the records, necessary orders would be passed. 6.In the light of the above, the writ petition is disposed of by directing the 2nd respondent to pass necessary orders as stated in the counter affidavit, after hearing the petitioner as well as the legal heirs of the deceased 4th respondent. The above said exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

5.The writ petition is disposed of with the above direction. No costs.
