Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the second respondent to issue the Transfer Certificate along with the necessary documents for the completion of the Academic Year 2014-15 to the petitioner Master.S.Raghul based on the representation dated 02.05.2015.

By consent, the writ petition is taken up for final disposal.

The deponent of the affidavit is the father of the minor son, viz., Raghul, who is aged about 13 years and according to him, he is studying 7th standard 'F' section at Sethu Baskara Matriculation Higher Secondary School, Pudhur, Ambattur, Chennai -53 (second respondent) and he has successfully passed the annual examination. The father of the petitioner would further submit that on account of personal reasons, he is not able to continue the studies of his son https://hcservices.ecourts.gov.in/hcservices/

at Ambattur and applied for transfer certificate. The grievance expressed by the petitioner is that for that purpose, the second respondent school authorities demanded a sum of Rs.10,000/- and inspite of repeated requests, the second respondent has refused to give transfer certificate so as to enable the minor son to join other educational institution. The petitioner in this regard had submitted a representation dated 02.05.2015 to the second respondent with a copy marked to the first respondent and also sent a legal notice on 12.05.2015 to the second respondent with a copy marked to the first respondent and though the representation as well as legal notice were acknowledged, the petitioner has not favoured with any kind of response and hence came forward to file this writ petition.

3. Heard the submissions of Mr.V.Kannadasan, learned counsel appearing for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice for the first respondent.

This court, without going into the merits of the representation, directs the first respondent to consider and dispose of the petitioner's representation dated 02.05.2015 as well as the legal notice sent on his behalf dated 12.05.2015 in accordance with law, after putting on notice the second respondent and pass orders as expeditiously as possible and not later than one week from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner and also to the second respondent. 5.
