Respondents Prayer: Petition filed under Section 5 of the Limitation Act, to condone the delay of 664 days in filing the writ appeal against the order dated 09.02.2023 made in W.P.No.27284 of 2015. For the Petitioners :

ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) The present petition has been filed to condone the delay of 664 days in filing the writ appeal.

2. Heard Mr.R.Neelakandan, learned Additional Advocate General assisted by Mr.E.Vijay Anand, learned Additional Government Pleader appearing for the petitioners, Mr.S.N.Ravichandran, learned counsel appearing for Mr.T.Ranganathan, learned counsel for the first respondent and Mr.R.A.Gopinathan, learned Standing Counsel for the second respondent.

3. Though some reasons have been stated at paragraph 11 of the affidavit filed in support of this petition to condone the delay, we are inclined to allow the present petition only on terms, as there has been some prejudice definitely caused to the first respondent/writ petitioner.

4. Therefore, this petition is ordered on payment of Rs.5,000/-, which shall be paid by the present petitioners/appellants to the first respondent/writ petitioner through the learned counsel appearing for the first respondent/writ

petitioner within a period of two weeks from the date of receipt of a copy of this order.

5. On such condition, the delay of 664 days in filing the writ appeal is condoned and accordingly, the present petition stands ordered.
