A.No.5905 of 2016 in C.S.No.799 of 2011 N.Sathish Kumar, J., This application has been filed to amend the plaint to include the date of death of Chinna Govindasamy and the plaintiff's mother one Komala. Consequently, amendment in respect of closing down the TASMAC shop in the suit property, owned by 16th defendant.

2. The prayer for mandatory injunction is sought to be amended. Amendment in the application does not change the nature of the suit. I am inclined to allow the application and the defendants can very well file the additional written statement with regard to the amendment.

3. With the above observation this application is allowed. Amendment should be carried out and the amended plaint copy shall be filed by 05.01.2017. 20.12.2016 pvs
