ORDER : The Court Made the following order :- The petitioner herein, who was arrested for the alleged offence under Section 174 Cr.P.C. altered to 120(b), 201 and 302 of I.P.C in Crime No.214 of 2022, seeks bail.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.This petitioner is arrayed as A6 in a case of murder of one Abi Sundar, aged 17 years old. Initially a case under section 174 Cr.P.C. was registered by the respondent police. Immediately removing the body of the deceased from the Well of one Paneer selvam, they found the external injury over the body of the deceased person and on investigation, it has come to light that the deceased had illegal intimacy with the wife of Ilayaraja and a complaint was registered against the deceased on 29.09.2021. Based on the complaint given by Ilayaraja, the deceased was arrested. Later on, he was released on bail and he left Chennai.
A week before the incident, he has come back to the village and on seeing him, the petitioner and the other accused, who are the close relatives of Ilayaraja, had infuriated and conspired to murder the said Abi Sundar. Pursuant to the said conspiracy, on 09.03.2022, they followed the deceased and when he was whizzing in the field of Paneer Selvam, they attacked him and https://hcservices.ecourts.gov.
thrown him into the well. The Post Mortem Report indicates multiple external injuries on the body of the deceased and the deceased died due to asphyxia as a result of drowning. The investigation reveals that this petitioner who was the former President of that village and the close relative of the said Ilayaraja has planned to commit the murder and execute the same with the help of others.
4. Considering the nature of the crime and the stage of the investigation, this Court is not inclined to grant bail to the petitioner. Hence this Criminal Original Petition for bail is dismissed.
