ORDER
The petitioner, who was arrested and remanded to judicial custody on 29.01.2026 for the alleged offences under Sections 126(b), 296(b), 132 and 351(3) of B.N.S. read with Section 7(1)(a) of CLA and Section 25(1-A) of Arms Act in Crime No.37 of 2026 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 29.01.2026 at about 4 p.m., when the respondent police were on routine surveillance near Jayapuram Junction, they found the petitioner in possession of knife and was threatening the public and abusing in filthy language and also threatened the police. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that due to a wordy quarrel between the petitioner and the police, this false case has been foisted against the petitioner, nobody was injured and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed to grant bail to the petitioner.
4. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail on the ground that there are three other previous cases pending against the petitioner, among which, two cases have been registered under NDPS Act.
5. From the submissions made by the learned Government Advocate, it appears that the petitioner is having two NDPS cases in his credit and yet another IPC case. Further it is amply clear from the submissions made by the
learned Government Advocate that whenever the petitioner is enlarged on bail, he had misused the liberty granted to him and again committed similar nature of offences. In such view of the position, though the petitioner has been under incarceration from 29.01.2026, taking into consideration of the interest of society at large, this Court is not inclined to enlarge the petitioner on bail at this juncture.
6. Accordingly, this Criminal Original Petition is dismissed. 09-03-2026 MJS Note:
