Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other appropriate writ, order or direction in the nature of a writ forbearing the respondents herein from in any manner laying or expanding the existing Gandhi road without any proceedings under the relevant land acquisition proceedings in respect of the petitioner's land situated at S.No.265/2 now T.S.No.30/2(part) in Vanuvampet, Adambakkam village, Nehru Street, Co-operative Nagar, Chennai For petitioner : Mr. K. ORDER
The present petition has been filed seeking to forbear the respondents herein from laying or expanding the existing Road without any due process of law.
2. When the matter is taken up for hearing, the learned counsel appearing for Respondents 1 & 2 that though the present petition has been filed for restraining the respondents from https://hcservices.ecourts.gov.in/hcservices/
encroaching the petitioner's land by expanding the existing road nearby, however, no such attempt has been made by the respondents and the present petition has been filed on a mere apprehension of the petitioner. It is further submitted by the learned counsel that respondents will not interfere with the petitioner's land without any due process of law.
