Respondent Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondent to grant permission and protection to conduct cultural program (Dance and Music Program) in Sri Aruncholaiamman Temple situated at South Street, Thenkumarai (Post), Aathur Taluk, Salem District 636 121, scheduled to be held on 09.06.2015 from 7.00 p.m to 11.00 p.m.

By consent, the writ petition is taken up for final disposal.

The petitioner claims to be the ''Dharmakartha'' of Sri Aruncholaiamman Temple, South Street, Thenkumarai (Post), Aathur Taluk, Salem District and according to him, every year during this month, temple festival used to be conducted. The petitioner submitted an application/representation dated 01.06.2015 to the respondent praying for permission to conduct the temple festival by conducting cultural events especially Orchestra and Koothu Program (dance program) as a part of celebration and since he has not favoured with any response, he came forward to file this writ petition.

Mr.N.Desinghu, learned counsel for the petitioner, on instructions, would submit that in the event of permission being granted to conduct the said program, there will not be any law and order problem and indecency or obscenity and prays for appropriate orders.

The court heard the submissions of Mrs.P.Rajalakshmi, learned Government Advocate, who accepts notice for the respondent.

This Court, without going into the merits of the representation/application, directs the respondent to consider and dispose of the petitioner's representation/application dated 01.06.2015 in accordance with law and pass orders on or before 07.06.2015 and communicate the decision taken, to the petitioner. 6.
