Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.A.SIVAJI, Advocate for the petitioner and of MR.V.

NICHOLAS Advocate on behalf of the Respondents the court made the following order:- This petition for stay is wholly misconceived. A suit for declaration and injunction was decreed by the Trial Court as prayed for. On Appeal the Appellate Court affirmed the decree for injunction while setting aside the decree for declaration. In such circumstances, there is no question of any further proceedings pursuant to the said decree at the instance of the respondents. Hence the application for stay is dismissed.
