Respondents PRAYER This writ petition is preferred under Article 226 of the Constitution of India seeking to issue a WRIT OF MANDAMUS, or any other appropriate writ, order or direction, directing the respondent No.1 to consider the dispose of the Petitioner's representation dated 17.11.2021 within a stipulated time frame and take appropriate action against Respondent No.4 and pass such other or further 1/5

orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of this case and thus render justice. For Petitioner:

ORDER

The petitioner has filed the present writ petition seeking mandamus directing the first respondent to consider and dispose of the representation of the petitioner dated 17.11.2025.

2.Mr.R.Gokulakrishnan, learned counsel on record for the petitioner is before this Court.

3.The learned counsel for the petitioner submitted that the petitioner had availed loan from the 4th respondent financial company by keeping the original house property documents as security and he has repaid the loan amount periodically to the fourth respondent on various dates. However, the said amounts were not credited to his loan account and they were misappropriated and now, the finance company is demanding money from the petitioner and has sent a legal notice threatening that legal action will be initiated for recovery of the amount. Therefore, the petitioner had sent a representation on 17.11.2025 to the Chief Minister's Cell and to the District Collector, Ariyalur. The third 2/5

respondent had received the complaint of the petitioner and the petitioner was also called for an enquiry and thereafter, no action has been taken. 4.Mr.Leonard Arul Joseph Selvam, learned Additional Public Prosecutor who takes notice for the respondents 2 and 3 submitted that the complaint was closed and that the petitioner was informed that he should approach the District Crime Branch.

5.This Court has considered the submissions made by both sides. It is to be seen that the petitioner in his complaint has very clearly mentioned about the person who has retained the property documents of the petitioner, namely the Five Star Business Finance Limited in Vridhachalam Branch, but no enquiry has been conducted with the fourth respondent and that the finance company was not even called for any enquiry and that the closing the complaint of the petitioner is not proper and appropriate enquiry should have been conducted. 6.In the light of the above, the third respondent Inspector of Police is directed to take the complaint of the petitioner on file, assign the CSR number and conduct enquiry with the petitioner and with the fourth respondent in accordance with law and thereafter, take appropriate action if required and shall register a case in this case by following due process of law. The petitioner shall appear before the third respondent on 10.04.2026 for an enquiry and the third respondent shall also ensure the presence of the fourth respondent for an enquiry on that day.
