O R D E R

Heard the learned counsel appearing for the petitioner and Mr.Mohamed Riyaz, learned Government Advocate (crl. Side) appearing for the respondent.

2.The petitioner herein has filed Crl.O.P.No.8379 of 2016 under Section 482 Cr.P.C. seeking a direction to the respondent police to investigate the Crime No.98 of 2016 on the file of the second respondent police and to file final report before the appropriate jurisdiction Magistrate. This Court, by order dated 20.04.2016, directed the second respondent therein to complete the investigation in Crime No.98 of 2016 and file a final report, within a period of three months from the date of receipt of a copy of the said order.

3.According to the petitioner, the respondent/contemnor, who is the second respondent therein, has neither conducted any enquiry nor registered a case and that he has willfully disobeyed the order passed by this Court. Hence, the petitioner, has filed the present contempt petition.

4.Today, the respondent/contemnor has filed counter affidavit, stating that in obedience of the order passed by this Court dated 20.04.2016, investigation has been completed and charge sheet has been filed against the accused persons A1 to A4 and absconding charge sheet was filed against A5, before the learned Judicial Magistrate Court, Tambaram on 05.11.2016 and the same was taken on

file in C.C.No.289 of 2016 on 16.11.2016. He also tendered his unconditional apology for the delay in implementing the order of this Court dated 20.04.2016.

5.In pursuant to the order passed by this Court dated 20.04.2016, though the investigation was completed and charge sheet has been filed with considerable delay, recording the unconditional apology tendered by the respondent for the delay in implementing the order of this court dated 20.04.2016, this Contempt Petition is closed.
