(Crime No. 23/2026.) ..Respondents PRAYER: Criminal Original Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the learned Principal District Sessions Judge under SC/ST(P.A) Act, Namakkal to consider the bail application of the petitioners on their surrender in Crime No. 23/2026 on the file of the respondent police on the same day.

ORDER

The present Criminal Original Petition has been filed seeking a direction to the Principal District Sessions Judge, Special Court for SC and ST Act cases, Namakkal District, to accept the surrender of the petitioners and consequently consider their bail petition on the same day, on merits, in connection with Crime No.23 of 2026 on the file of the second respondent Police.

Heard the learned counsel appearing for the petitioners as well as the learned Additional Public Prosecutor appearing for the respondents. 3.

It is seen from the records that a wordy quarrel arose between the petitioners and the de facto complainant, when the de facto complained questioned the petitioners regarding dumping of garbage in front of his house wherein the petitioners are said to have abused the de facto complainant by calling his caste name.

In view of the above factual position, there shall be a direction to the learned the Principal District Sessions Judge, Special Court for SC and ST Act cases, Namakkal District, to consider the petitioners' bail application, preferably on the same day of their surrender, in connection with Crime No.23

of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
