ORDER

This Writ Petition is filed for a direction to the respondent Nos.1 and 2 to conduct an enquiry and register an F.I.R against the respondent Nos.3 and 4 based on the petitioner's complaint, dated 03.10.2024.

2. The petitioner had given a representation, dated 03.10.2024. Thereafter, no action has been taken despite specific allegations made against the respondent Nos.3 and 4 who are obstructing the petitioner's peaceful possession and enjoyment of the property.

3. The learned Counsel for the petitioner, on instructions, submits that the petitioner is ready to appear before the respondent Police on 24.03.2026 along with the supporting documents, but, their only objection is that the respondent Police is insisting for original documents of the year 1939 without any acknowledgement.

4. The learned Additional Public Prosecutor for the respondent Nos.1 and 2 submits that after receipt of the petitioner's complaint, the Sub-Inspector of Police, Perumbakkam Police Station had issued a notice 2/5

to the petitioner for his appearance, but, he did not appear.

5. In view of the above, the second respondent is directed to conduct an enquiry, collect the documents, issue notice to the counter petitioners, the respondent Nos.3 and 4 and to complete the process of enquiry on the petitioner's complaint within a period of two months from the date of their appearance. It is made clear that the petitioner can take original documents along with the photostat copies of the same and the photostat copies alone be given. The second respondent is directed to compare the photostat copies with the original documents, but, cannot insist for retention of the original documents. If there are any compelling reasons, the second respondent shall give a detailed reason why original documents are required.

6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
