ORDER

This Writ Petition has been filed for a direction, directing the respondents 1 to 3 to provide police protection to the petitioner for fencing and developing his properties situated in survey Nos.39/1 (1.36 acres), 39/7(1.50 acres), 39/7A (0.42 acres), 39/7B (1.00 acres), 39/8A (1.00 acres), 39/8B (2.00 acres), 39/9 (3.00 acres), 39/10C (0.85 acres), 39/11B (0.27 adres), 59/5(1.89 acres) and 64/1 (0.43 acres) at Punuganthotti Village, Hosur, Krishnagiri District,based on the petitioner's representation dated 13.08.2024.

It is the case of the petitioner that he purchased the property in S.Nos.39, 59, 64 and its subdivisions at Punuganthotti Village, Hosur, Krishnagiri District to an extent of 13.7 acres and registered the said properties. Thereafter, the petitioner is in possession and enjoyment of the property and all the revenue records were also transferred in the name of the petitioner. When the petitioner was about to put up fencing in his property , the private respondent who are local villagers, barged into the property illegally and prevented the fencing the process. Hence, the petitioner has given a representation dated 13.08.2024 to the 1st and 2nd respondent to provide police protection for the same. However, no action has been taken on the said representation. Aggrieved by the same, the petitioner has filed the present writ petition.

3. Heard the learned counsel on either side and also perused the materials available on record.

4. On perusal of records it would show that there is a civil dispute

between the petitioner and the respondents 4 to 8 herein. The petitioner ought to have approached the Civil Court as against the respondents 4 to

8. Therefore, police protection cannot be granted to the petitioner for fencing and developing his properties situated at Punuganthotti Village, Hosur, Krishnagiri District. Hence, the prayer sought for in this petition cannot be considered on the representation of the petitioner dated 13.08.2024 and is liable to be dismissed.
