PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code with a prayer to direct the second respondent to file a report pertaining to the detention of the deteneu by name Devi and in pursuance direct the IV Metropolitan Magistrate, Saidapet, Chennai to dispose the Crl.M.P.No.64 of 2020 in Crime No.20 of 2020 on the file of the first respondent.

The petitioner is the father of the victim. It is submitted that the victim has two children aged about 9 years and 2 1/2 years respectively. One of her children is a special child and therefore, her presence is very much essential.

2. Heard the submissions made on either side.

3. Considering the submissions made, an interim direction is given to the third respondent Superintendent, Government Home for Women, 2/5

Mylapore, Chennai to release the victim forthwith as an interim measure subject to the final orders to be passed by the concerned Magistrate as well as the Governmental restrictions with respect to positive cases of Novel Corona Virus (COVID-19). The victim shall keep herself in isolation in her house till the disposal of the petition filed before the concerned Magistrate. 17.04.2020 TK 3/5
