The Criminal Original Petition has been filed seeking for a direction to the respondent to register the complaint dated 08.11.2019 lodged by the petitioner.
2. Learned counsel for the petitioner would submit that the petitioner had filed CMP No.805 of 2020 under Section 156 (3) Cr.P.C and the same has been taken on file by the learned District Munsiff cum Judicial Magistrate, Mettupalayam and the learned Magistrate by order dated 13.10.2020, had directed the respondent to register the complaint. However, the respondent had not registered the case. Thereby, the present petition has been filed, seeking for a direction to the respondent to register the complaint lodged by the petitioner.
3. Mr.V.Meganathan, learned Government Advocate (crl.side) would submit that the complaint was given by father in law/petitioner against his daughter in law, in respect of the claim of death benefits of his son. The petitioner had filed CMP No.805 of 2020 before the learned District Munsiff cum Judicial magistrate, Mettupalayam.
Pursuant to which, preliminary enquiry was conducted and the same has been closed by the respondent. He would submit that the closure report was also https://hcservices.ecourts.gov.in/hcservices/
filed before the jurisdictional Court.
4. At this juncture, learned counsel for the petitioner would submit that the petitioner has not received the closure report.
5. In view of the above, direction is issued to the respondent to furnish the copy of the closure report to the petitioner within a period of two weeks from the date of receipt of a copy of this Order. On such receipt, the petitioner is at liberty to challenge the closure report by way of filing protest petition in accordance with law.
6. With the above direction, this Criminal Original Petition stands disposed of.
