This matter was taken up for hearing under the caption "For Being Mentioned" today at the instance of the learned counsel for respondents 1 and 2.

2.The learned counsel for respondents 1 and 2 submitted that this court by an order dated 07.04.2026 allowed the Civil Revision Petition and directed the trial judge to dispose the application filed in I.A.No.1 of 2026 in O.S.No.175 of 2025. However, he would submit that within a period of one week, the application could not be disposed of. Therefore, he prayed to grant some more time to dispose the application and issue fresh order copy.

3. Considering his submissions, Registry is directed to substitute the words in para 4 of the order viz., "within a period of one week from the date of receipt of copy of this judgement" as "within a period of two weeks from the date of receipt of copy of this order". 1/10

4. Registry is directed to incorporate above modification in the Order of this Court passed in C.R.P.No. 1840 of 2026 dated 07.04.2026 and issue fresh order copy to the learned counsel for respondents 1 and 2. 24.04.2026 rpp 2/10

ORDER

This Civil Revision Petition has been filed seeking to dispose IA.No.1/2026 in OS.No. 175/2025 on the file of the District Munsif Court at Chengalpat within the time fixed by this Court.

2. The learned counsel for the petitioner has filed suit in OS.No. 175/2025 on the file of the District Munsif Court at Chengalpat, seeking relief of declaration and permanent injunction more particularly against 1st defendant association and its individual flat owners. While so, the petitioner filed IA.No.1/2026 in OS.No. 175/2025 seeking temporary injunction wherein the defendants also raised their objections but they have not filed any counter for the past one year. Hence, he prays to fix time to dispose of the said application.

3. Heard the submission of the learned counsel for the petitioner.

4. The reason assigned by the petitioner is justifiable. The District Munsif Court, Chengalpat is directed to dispose of the IA.No.1/2026 in 8/10

OS.No. 175/2025 after hearing both sides within a period of one week from the date of receipt of a copy of this judgement. Accordingly, this Civil Revision Petition is allowed. No Costs. Pending miscellaneous petition, if any, is/are closed.
