This petition has been filed seeking to condone the delay of 363 days in filing the Civil Miscellaneous Appeal.

Mr.M.B.Raghavan, learned counsel for the third respondent Insurance Company submitted that the first respondent, the driver of the vehicle remained ex-parte before the trial Court.
However, papers have been served on him.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 363 days in filing the Civil Miscellaneous Appeal is condoned, subject to the condition that the claimant/petitioner will not be entitled to interest for the delay period i.e., for 363 days, in the appeal.

Post the matter after four weeks.
