Heard learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the first Respondent and Mr.S.Senthamil Selvans, learned counsel for the second respondent.

2. This petition has been filed to quash the FIR in Crime No.33 of 2010 on the file of the first respondent.

3. Now the learned Government Advocate ( Criminal Side) represented that the first respondent/Inspector of Police has filed the charge sheet before the Judicial Magistrate II, Vellore and the same has been taken on file in C.C.No.210 of 2011.

4. In view of the said submissions, the Criminal Original petition is not at all maintainable. Learned counsel for the petitioner seeks liberty to file a petition challenging the charges framed by the trial Court.

5. In view of the reasons stated above, the Criminal Original Petition is dismissed as not maintainable. Liberty is given to the petitioner to challenge the charges if any sufficient grounds available to the petitioner. Consequently, connected miscellaneous petition is dismissed.
