With the consent of the learned counsel appearing on either side, this writ petition is taken up for final disposal.
2. Heard Mr.R.Mohan, learned counsel for the petitioner and Mr.G.Janakiraman, learned counsel for the respondents.
3. This writ petition has been filed praying to direct the respondents, to provide drainage and water service connection, after registering the applications, to the flats and common areas, forming part of the plan approval, dated 17/5/2011 and completion certificate dated 20/10/2015, issued by CMDA, put up at T.S.Nos.80/1 to 12, 113/2,3 and 4 of Block 38 Arunachalam Road, Saligramam, Chennai 93.
4. Earlier, the petitioner had filed another writ petition in W.P.No.1557 of 2016, for a direction to the Electricity Board to give electricity service connection. Subsequently, the Electricity Board, having been satisfied that the petitioners have complied with all the conditions, had granted electricity service connection and therefore, the writ petition was withdrawn, on 2/2/2016.
5. The learned Standing counsel appearing for the respondent Board, submitted that four weeks time may be granted to the respondent, to process the application, as road cutting permission has to be obtained from the Corporation of Chennai.
6. Firstly, the authority should be satisfied that the construction put up by the petitioner is in accordance with law, as per the sanction plan. In this case, this appears to be not in doubt because the petitioner has produced the completion certificate. Therefore, all that the respondent has to verify the same and proceed further to take action to provide Water and Sewerage connection.
7. The request made by the respondents, to grant four weeks time, is accepted and accordingly, the respondents are directed to verify the completion certificate and take necessary steps, for effecting Water and Sewerage connection. The said exercise, shall be completed, within a period of four weeks, from the date of receipt of a copy of this order.
8. With the above direction, this writ petition is disposed of.
No costs.
Consequently, the connected Miscellaneous Petition is closed.
