...RESPONDENTS Writ Petition filed under Article 226 of the Constitution of India for the issue of Writ of Mandamus, directing the respondents to sanction minimum pension to the petitioner by taking into consideration the earlier service rendered by the petitioner as Village Servant prior to 1980 at par with others who have been granted pension and draw and disburse the same within a reasonable time.

In view of the limited prayer made during the course of hearing the Writ Petition, by consent, the Writ Petition itself is taken up for final disposal.

The petitioner was appointed as Village Headman on 12.07.1999 by the orders of the 3rd respondent herein and thereafter, he served as Village Headman from 12.07.1979 to 25.12.1979. However, the post of Village Headman was abolished on 14.11.1980 by the Government of Tamil Nadu. Later, the petitioner became a Village Administrative Officer in the year 2000. He retired from service on 31.10.2009 on reaching the age of superannuation. He did not complete 10 years of service as a regular Village Administrative Officer.

According to the petitioner, the Government issued a Government Orders in G.O.(D) No.678, Revenue Department, dated 16.11.2007 and G.O.(D) No.655, Revenue Pani (2) Department, dated 10.12.2010, granting minimum pension to the Village Administrative Officers, who did not render minimum 10 years of service, but who worked earlier as part time Village Munsif or Karnam etc. Thereafter, the petitioner made a representation dated 06.02.2012 to the District Collector, Vellore for payment of minimum pension. 4.
The learned Senior Counsel for the petitioner would submit that the 1st respondent could be directed to pass orders on the aforesaid representation dated 06.02.2012 within a stipulated time fixed by this Court.

In view of the limited prayer now made by the learned Senior Counsel for the petitioner, the Writ Petition is disposed of, directing the 1st respondent to consider and pass orders on the representation of the petitioner dated 06.02.2012 on merits and in accordance with law and also in the light of the Government Orders in G.O.(D) No.678, Revenue Department, dated 16.11.2007 and G.O.(D) No.655, Revenue Pani (2) Department dated 10.12.2010, within a period of 12 weeks from the date of receipt of a copy of this Order. No costs.
