Respondents Prayer:- Writ petition has been filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus , directing the 1strespondent to expedite Coronavirus or COVID-19 test to infected person, person who are contact with infected person and people living in the infected person areas around.

ORDER

[Order of the Court was made by M.SATHYANARAYANAN,J.,] (1)The learned counsel for the petitioner, on instructions, would submit that as on 17.05.2020, 3,23,727 samples have been collected and it represents 4529 per million and the State Government is also taking all out efforts to test the persons and find out the infection with COVID-19 virus and therefore, nothing remains for further adjudication in this writ petition. (2)The Court heard the submissions of Mr.V.Jayaprakash Narayan, learned Government Pleader for the 1st respondent and Mr.G.Rajagopalan, learned Assistant Solicitor General of India for the 2nd respondent.

(3)The learned Government Pleader has drawn the attention of this Court to the counter affidavit of the 1st respondent dated April 2020 and would submit that the Government is taking all out efforts as well as necessary control measures to prevent COVID-19 spread and it is also meticulously following guidelines the Indian Council for Medical Research [ICMR] as well as World Health Organization [WHO] regarding the testing of the suspected cases and since the grievances of the petitioner have been addressed, prays for dismissal of the writ petition.

(4)In the light of the submissions made by the learned counsel for the petitioner coupled with the materials placed before this Court, this Court is of the considered view that as on date, the State Government is taking measures in the form of collection of samples to control the spread of COVID-19 pandemic virus and as such, no further orders could be passed in favour of the petitioner.
