Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration or any other writ or order of similar nature declaration the reduction of pensionary benefits payable to the petitioner through P.P.O.No. C81660/CT dated 14.08.2002 and P.P.O No. C113358/Edg, dated 14.09.2001 is null and void and consequently direct the respondent to refund the withhold amount from the pension to the petitioner with interest.

O R D E R

The prayer sought for in the Writ Petition is to declare the reduction of pensionary benefits payable to the petitioner through P.P.O.No. C81660/CT dated 14.08.2002 and P.P.O No. C113358/Edg, dated 14.09.2001 is null and void and consequently direct the respondent to refund the withhold amount from the pension to the petitioner with interest.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent and perused the materials available record.

3. Today when the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that the petitioner died on 25.11.2016 and thereafter, he has not received any instructions from the legal heirs of the petitioner to proceed with the writ petition.

4. In view of the above submissions made by the learned counsel for the petitioner, the Writ Petition stands dismissed as abated. No costs. Consequently, connected Miscellaneous Petition is closed.
