T.SHUNMUGARAJESWARAN, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 4(1)(a), 4(1-A), 24 of TNP Act, in Crime No.151 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that TASMAC liquor was sold at higher price in the liquor shop belonging to the petitioner. On inspection, 45 Beer Bottles, 6 Brandy Bottles and a sum of Rs.18,750/- was recovered from the petitioner's shop. Hence, the complaint was registered.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. Side) submits that the petitioner along with the other accused person were found selling TASMAC liquor at higher price. He further submitted that A1 has already been arrested and remaned to judicial custody. He would further submit that the custodial interrogation of the petitioner is required. Hence, he vehemently opposed to grant of anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and that the petitioner has involved in very serious offence, this Court is not inclined to grant anticipatory bail to the petitioner.
