DATED : 20.04.2020

CORAM

THE HONOURABLE MR. JUSTICE R.SUBRAMANIAN Crl.O.P.No.7281 of 2020 1.Bala @ Balamurugan 2.Surya @ Katna Surya @ Muthumari 3.Siva @ Mittai Siva 4.Saravanan @ Kaliya 5.Rajesh @ Sathish Kumar ... Petitioner Vs.

The State Rep. By its Inspector of Police, Vellithirupur Police Station, Erode.

... Respondent Prayer: Criminal Original Petition filed under Section 439 of Cr.P.C. to enlarge the petitioners on bail, in Crime No. 15 of 2020 pending investigation on the file of the respondent police.

For Petitioners : Mr.M.Kaveri Selvam For Respondent : Mr.S.Karthikeyan Additional Public Prosecutor

ORDER

The petitioners seek bail in respect of Crime No. 15 of 2020 registered against him under Sections 147, 148, 341, 120(B) & 302 of I.P.C and they

have been arrested on 05.02.2020.

2. The learned counsel appearing for the petitioner would submit that they have been in prison for more than 45 days. The learned Additional Public Prosecutor would oppose the grant of bail on the ground that it is a case of retaliatory murder and each of the petitioners have got previous cases against them while A2 got five cases against him, A3 and A4 have got two cases each, A5 got 4 cases and A6 got 1 case.

3. Considering the fact that it is a retaliatory murder, I do not think it will be safe to enlarge the petitioners on bail in the prevailing situation. Hence, this bail petition is dismissed for the present. 20.04.2020 kkn To
