IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED : 21.04.2020

CORAM

THE HONOURABLE MR. JUSTICE R.SUBRAMANIAN Bramma Moorthy ... Petitioner Vs.

The State represented by Inspector of Police, Komarapalayam Police Station, Namakkal District.

... Respondent Prayer : Criminal Original Petition filed under Section 439 Cr.P.C. to enlarge the petitioner on bail in connection with Crime No.188 of 2019 pending investigation on the file of the respondent police. For Petitioner : Mr.M.Subash For Respondent : Mr.S.Karthikeyan Additional Public Prosecutor

O R D E R

The petitioner seeks bail in respect of Crime No.188 of 2019. The petitioner has been charged with offences under Sections 454, 457 and 380 IPC.

2.The petitioner was remanded to custody on 12.03.2020. A perusal of the FIR shows that the petitioner has 11 previous cases against him and all are of similar nature. It appears that the petitioner is an habitual offender and I do not think it will be safe to enlarge the petitioner on bail in the current situation as there is every possibility of his restarting his profession of theft, particularly when the attention of the police is engaged in enforcing the lock down.

Hence, this bail petition is dismissed for the present. 21.04.2020 mkn To 1.The Inspector of Police, Komarapalayam Police Station, Namakkal District.

2.The Public Prosecutor, High Court, Madras.

3.The Superintendent, Central Prison, Salem.
