ORDER

The petitioners, who apprehends arrest for the alleged offences under Sections 126(2), 296(b), 115(2), 118(1), 109(1), 351(3) of BNS r/w. Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act in Crime No.60 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that due to previous enmity, the petitioner along with other accused assaulted the defacto complainant, as a result of which she was hospitalized.

3. The learned counsel for the petitioner submits that the petitioners have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the investigation is still pending and hence, he prayed to dismiss the present criminal original petition.

5. Heard the arguments advanced on either side and perused the materials available on record.

6. From the submission made by the learned counsel for the petitioner, this is the case of tussle between two neighbours and that specific overtact of this petitioner is that he attacked the defacto complainant by a wooden log. At this juncture, the learned Government Advocate strongly opposes the bail application, as the defacto complainant was admitted in hospital on 28.02.2026 and was discharged only on 04.03.2026. His further submission is that the investigation is still pending. In such view of the submission, considering the nature of injuries and serious allegation against these petitioners, they do not deserve anticipatory bail.
