ORDER

The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS, 2023, in Crime No.16 of 2026, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 100 kgs of river sand. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that this is the second anticipatory bail petition and the earlier anticipatory petition was dismissed by this Court in Crl.O.P.No.3363 of 2026. He further submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are three previous cases pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission of the learned counsel on either side, this Court is of the view that the petitioner has criminal antecedents and that there is no change in circumstances from the earlier dismissal of the petition, hence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original petition is dismissed. 12-03-2026 MPA To 1.The Inspector of Police, Melpatti Police station, Vellore District.
