Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 4 to dispose of the petitioner's representation dated 13.12.2021 to cancel the patta No.2747 of 5th respondent in Old Survey No.93/3, New Survey No.93/7, Kakkalur Village, Thiruvallur Taluk, Thiruvallur District. For Petitioner : Mr.C.Venkatesan For Respondents : Mr.A.Selvendran, SGP for R1 to R4

ORDER

This Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 to 4 to dispose of the petitioner's representation dated 13.12.2021 to cancel the patta No.2747 of 5th respondent in Old Survey No.93/3, New Survey No.93/7, Kakkalur Village, Thiruvallur Taluk, Thiruvallur District.

2. With the consent of both sides, this Writ Petition is disposed of at the admission stage itself.

3. Heard Mr.C.Venkatesan, learned counsel for the petitioner, Mr.A.Selvendran, learned Special Government Pleader for the respondents.

Though the Writ Petition has been filed to direct the respondents 1 to 4 to dispose of the petitioner's representation dated 13.12.2021 to cancel the patta No.2747 of 5th respondent in Old Survey No.93/3, New Survey No.93/7, Kakkalur Village, Thiruvallur Taluk, Thiruvallur District, on perusal of the records, it appears that the petitioner has filed a similar Writ Petition in W.P.No.12485 of 2013. In the said Writ Petition , this Court directed the respondents to pass orders on merits. Pursuant to the same, orders have been passed by the Tahsildar, rejecting the petitioner's claim.

In such view of the matter, challenging Na.Ka.No.4578/2013/A1, let the petitioner file an appeal before the Appellate Authority by producing all the necessary documents. If such appeal is filed, the Appellate Authority shall dispose of the appeal on its Page No.3 of 6

own merits and in accordance with law.

6. With the above observations, this Writ Petition is disposed of. No costs.
