ORDER : The Court Made the following order :- The petitioner, who apprehending arrest for the alleged offence under Section 406, 420 & 506(1) of I.P.C., in Crime No.4 of 2022, on the file of respondent police, seeks anticipatory bail.
2. The content of the petitioner as well as the counter filed on behalf of the state perused. As per the complaint, this petitioner along with three others have developed the acquaintance with the defacto complainant promising her to get loan to a tune of Rs.10 Lakhs and collected her Aadhar card, photograph and other personal documents but had not arranged for any loan. This incident has taken place in the year 2017. Suddenly, in the year 2020, the defacto complainant has received summons from the Income Tax Department, as if, she has failed to pay the tax for the business in the name and style of M/s.Sukumar Traders. Thereafter, on enquiry, she found that, copy of the Aadhar card and Voter ID obtained by the https://hcservices.ecourts.gov.in/hcservices/
petitioner and three others been misused to float the fictitious company in the name of M/s.Sukumar Traders and they have cheated the Government to a tune of Rs.80 Lakhs. Hence, complaint has been given and the respondent has commenced the investigation. This petitioner and others are still at large. Further, investigation of the respondent police has disclosed that the petitioner is adopting same modus operandi and had committed another offence and same been probed by M-6, Manali Police Station.
3. Considering the above fact this Court is not inclined to grant anticipatory bail. The custodial interrogation of the petitioner is very much required for investigation by the respondent police.
