ORDER

The petitioner, who was arrested and remanded to judicial custody on14.04.2020 for the offence punishable under Sections8 (c) and 20(b) (ii) (A) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.392 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found in possession of 525 gms of Ganja for illegal sale during this lockdown period.

3. The learned counsel appearing for the petitioner would submit that the 525 gms of Ganja is smaller quantity. Further the petitioner was arrested and remanded for judicial custodyfrom 14.04.2020 and sought for bail.

4. The learned Additional Public Prosecutor (Crl. Side) would submit that the petitioner is in possession of 525 gms of Ganja illegally and he is having seven previous cases similar in nature. He has involved in various bodily offences such as hurt cases, kidnapping cases and SC/ST PO Act Case. Recently he has involved in NDPS Cases (Selling of Ganja) in both Bhavani and Chithode Police station limits. Further the petitioner is a habitual offender and in fact he is a history sheeter. Hence he vehemently opposed for grant of bail to the petitioner.

5. Taking into consideration the nature of allegations against the petitioner in the FIR and also taking note of the fact that the petitioner is a history sheeter, this Court is not inclined to grant bail.
