The petitioner seeks bail in Crime No.201 of 2023, registered by the respondent police for the offences punishable under Sections 294(b), 451,216,149,302 of I.P.C r/w Section 4 of TN Prohibition of Harassment of Woman Act 2002. The petitioner had been taken into custody on 16.02.2024.

2. The petitioner is the owner of a car bearing Registration No.PY 01 CY 2508. This car was used by the other accused who were travelling in the same car and got down and murdered the deceased in front of the defacto complainant, wife of the deceased. It is stated that there were two seperate reasons for the said murder. The first one was political rivalry and the second one was community rivalry. It is also stated that the deceased had earlier murdered one of the person belonging to the accused group and in order to take revenge the accused persons had murdered the deceased.

3. The learned counsel for the petitioner stated that nine days prior to the occurrence, the petitioner had serviced the car tyres and he did not know anything about the other activities. It is stated that he belongs to Pondicherry State and he did not know anything about the murder. However, the petitioner had lent his car to those who had committed murder.

4. The learned Government Advocate appearing for the respondent submitted that charge sheet has been filed and investigation has been completed and the matter is now pending in P.R.C.No.8 of 2023. He further submitted that A1 is still absconding

5. Considering the nature of offence committed by the petitioner and also the fact that one of the accused is absconding, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
