CR.NO.2 OF 2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed against the petitioner in Crl.O.P.No.5385 of 2021 ordered on 25.03.2021 by directing in para 6(a) of the order that "The petitioner is directed to pay a sum of Rs.10,00,000/- (Rupees Ten Lakhs Only) to the credit of Crime No.2 of 2021 before the Judicial Magistrate, Tittakudi, within four(4) weeks from the date of receipt of a copy of this Order" to enable the petitioner to enlarge on bail. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. M.RAVINDHAR, Advocate for the Petitioner and of MR.K.MADHAN, Government Advocate (Crl.

side) on behalf of the Respondent the court made the following order:- This Criminal Miscellaneous Petition has been filed seeking to modify the condition imposed by this Court against the petitioner directing him to pay a sum of Rs.10,00,000/- (Rupees ten lakhs only) to the credit of Crime No.2 of 2021 before the Judicial Magistrate, Tittakudi within four weeks from the date of receipt of copy of the order.

2. The learned counsel appearing for the petitioner would submit that he is in jail. Hence, he is not able to mobilise the fund. He would also submit that he will deposit the amount of Rs.5,00,000/- and thereafter, after releasing him on bail, he will deposit the remaining amount of Rs.5,00,000/- within a period of four weeks.

3. Considering the facts and circumstances of the case, the condition already imposed on the petitioner in Crl.O.P.No.4946 of 2021, dated 25.03.2021 is modified, and the petitioner is directed to deposit a sum of Rs.5,00,000/- (Rupees five lakhs only) while executing sureties and after releasing him on bail, he shall deposit the remaining sum of Rs.5,00,000/- to the credit of Crime No.2 of 2021 before the Judicial Magistrate, Tittakudi within a period of four weeks from the date of releasing him from jail.

4. This petition is ordered accordingly.
